Terms & Conditions

These Terms & Conditions (the “Terms”) set out the basis on which Sophie Dibou sells makeup products and provides makeup education and training (together, the “Services”). By placing an order, booking a course, accessing our website, or otherwise engaging with us, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use our Services.


1. Who We Are & How to Contact Us

2. Definitions

  • Consumer: an individual acting wholly or mainly outside their trade, business, craft or profession.
  • Business Customer: any customer that is not a Consumer.
  • Products: makeup, tools, accessories, kits and any physical goods we sell.
  • Courses: in‑person classes, workshops, masterclasses, one‑to‑one training, and online courses (live or pre‑recorded), including any related materials and digital content.
  • Order: your request to purchase Products and/or Courses from us.

3. Eligibility & Your Responsibilities

You must be at least 16 to purchase Products or book Courses. Certain professional Courses may have a minimum age of 18 and/or prerequisite skills or qualifications; see Course pages for details. You are responsible for:

  • Ensuring that any information you provide to us is accurate and complete;
  • Checking for allergies and sensitivities (see Section 12);
  • Complying with any health and safety instructions we provide;
  • Using Products and Course knowledge responsibly and lawfully.

4. Placing Orders & Our Contract With You

  • Your Order is an offer to buy. We accept only when we send an order confirmation email (for Products) or booking confirmation (for Courses).
  • We may refuse or cancel an Order (for example, where a Product is out of stock, a Course is full, we cannot obtain payment, there is a pricing error, or you do not meet Course requirements). If we cancel after payment, we will refund you in full.

5. Prices, Taxes & Payment

  • Prices are shown in [Insert currency] and include/exclude VAT as stated on the Site.
  • We may change prices at any time; changes do not affect Orders already accepted.
  • You authorise us (or our payment processors) to charge your selected payment method for the full amount, including taxes, shipping, duties and fees.
  • Promotional codes and discounts are subject to the specific terms of that promotion and cannot be applied retrospectively or combined unless stated.

6. Delivery, Risk & Title (Products)

  • Delivery areas & costs: as shown at checkout. International customers are responsible for any customs duties, taxes, and import charges.
  • Timing: delivery dates are estimates; delays can occur. We are not liable for delays outside our control (see Section 20).
  • Risk & title: risk in Products passes on delivery; title passes only when we receive full payment.
  • Inspection: please inspect your parcel on arrival and notify us promptly of any damage, missing items or incorrect Products.

7. Returns & Refunds (Products)

Your legal rights are protected by the UK Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013 (the “Regulations”). In addition, our goodwill policy is as follows:

Change‑of‑mind (Consumers):

  • You have 14 days from delivery to cancel your purchase of most Products.
  • You must inform us within the 14‑day period and return the Products within a further 14 days in their original, unopened, unused condition with seals, hygiene stickers, and packaging intact.
  • We will refund the Product price (and the least‑cost standard delivery) within 14 days of receiving the returned items or proof of return. You are responsible for return postage unless the item is faulty or misdescribed.

Hygiene‑sealed items:

  • For reasons of health protection and hygiene, we cannot accept returns of cosmetic Products that have been unsealed, used, swatched, or otherwise not suitable for resale, unless they are faulty or misdescribed.

Faulty or misdescribed items:

  • If a Product is faulty or not as described, contact us promptly with photos. You may be entitled to a repair, replacement, or refund in line with your statutory rights.

Exclusions: personalised items, made‑to‑order items, and perishable or time‑limited promotional items are non‑returnable unless faulty.


8. Cancellations & Rescheduling (Courses)

The following applies in addition to your statutory rights under the Regulations.

In‑person Courses (open‑enrolment):

  • Free cancellation or reschedule up to 14 days before the Course start.
  • 7–13 days before start: reschedule to a later date (one time) or receive a 50% refund.
  • 0–6 days before start or no‑show: non‑refundable, non‑transferable.

Private or bespoke training:

  • Deposit is non‑refundable once dates are confirmed. Balance due 14 days before the session. Reschedule requests within 7 days may incur up to a 50% fee.

Online live Courses (via video):

  • Same timelines as in‑person. You are responsible for having a stable internet connection and suitable device. No refunds for technical issues on your side.

Digital Courses / pre‑recorded content:

  • By accessing or downloading the digital content within the 14‑day cooling‑off period, you expressly consent to immediate supply and acknowledge you lose your right to cancel under the Regulations. If you do not access the content, you may cancel within 14 days of purchase.

We may reschedule or cancel a Course if minimum numbers are not met, an instructor becomes unavailable, or for reasons outside our control. If we cancel, you may choose a new date or a full refund of the Course fee.


9. Course Requirements, Conduct & Outcomes

  • Some Courses may require you to bring a model; requirements will be stated on the Course page.
  • You agree to behave respectfully to tutors, staff, models, and other students. We may remove anyone whose behaviour is unsafe, disruptive, or abusive, without refund.
  • Certificates of attendance/achievement are not professional licences. Training does not guarantee employment, exam success, insurance eligibility, or regulatory approval. You are responsible for complying with local laws and professional standards.

10. Health, Allergies & Patch Testing

  • Ingredients lists are available on Product packaging and/or the Site. Always perform a patch test 24–48 hours before use and follow directions for use.
  • If you have known allergies, skin conditions, are pregnant, breastfeeding, or under medical care, consult a qualified healthcare professional before using Products or participating in Courses.
  • Do not share makeup or tools during Courses unless expressly instructed and sanitised. You must follow hygiene and safety protocols provided by tutors.

11. Photography, Filming & Privacy at Courses

  • We may photograph or film Courses for educational and marketing purposes.
  • If you prefer not to be photographed or filmed, please notify us before the session begins; we will take reasonable steps to accommodate.
  • Where you agree to be photographed/filmed, you grant us a non‑exclusive, worldwide, royalty‑free licence to use the resulting images/footage featuring you for marketing and training, in any media, for as long as they are relevant.
  • Our use of your personal data is governed by our Privacy Policy [link].

12. Use of Products & Safety Warnings

  • Use Products strictly in accordance with instructions. Avoid contact with eyes unless the Product is intended for eye use; if irritation occurs, discontinue use and seek medical advice.
  • Keep Products out of reach of children.
  • Professional Products must be used by trained individuals only.
  • We are not responsible for misuse of Products contrary to instructions or common industry practice.

13. Digital Content & Licence to Course Materials

  • All Course materials, handouts, videos, slides, templates, and digital downloads (“Materials”) are owned by us or our licensors.
  • We grant you a non‑exclusive, non‑transferable licence to use the Materials for your personal, non‑commercial study. You must not copy, share, sell, publish, record, stream, upload, or distribute Materials without our prior written consent.
  • Account credentials are personal; do not share access. We may suspend access if we detect misuse.

14. User Accounts, Reviews & Content

  • When you create an account or post a review, you must provide accurate information and not impersonate others.
  • You are responsible for keeping your login details confidential and for all activity under your account.
  • You warrant that any content you submit (e.g., reviews, images): (i) is your own, lawful, and not misleading; (ii) does not infringe third‑party rights; and (iii) is free of viruses or malicious code.
  • You give us a worldwide, royalty‑free, perpetual licence to use, reproduce, and display such content on our Site and marketing channels.

15. Gift Cards, Deposits & Pre‑orders

  • Gift cards are redeemable only on our Site, non‑refundable, non‑exchangeable for cash, and valid for the period stated on issue.
  • Deposits secure your place and may be non‑refundable where stated.
  • Pre‑order dates are estimates and may change; if we cannot fulfil a pre‑order within a reasonable time, we will offer a refund.

16. Intellectual Property on the Site

All trademarks, logos, brand names, photographs, product names, designs, text, and graphics on the Site are our intellectual property or that of our licensors. You may not use them without permission.


17. Third‑Party Services

We may use third‑party platforms (e.g., payment processors, e‑learning platforms, video‑conferencing tools, couriers). These providers have their own terms and privacy policies; your use of their services may be subject to those terms.


18. Liability

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited by law.

Subject to the above:

  • We are not liable for: (i) loss of data, profits, business, goodwill; (ii) indirect or consequential losses; (iii) allergic reactions where you have not followed patch‑testing guidance or usage instructions; or (iv) delays or failures due to events outside our control.
  • For Consumers, if we fail to comply with these Terms, our liability is limited to the price you paid for the relevant Product or Course, unless otherwise required by law.
  • For Business Customers, our total liability for any claim arising out of or in connection with these Terms is limited to the amount paid by you for the relevant Order in the 12 months preceding the claim.

19. Force Majeure

We are not responsible for any delay or failure to perform due to events beyond our reasonable control, including but not limited to acts of God, extreme weather, epidemic/pandemic, strikes, labour disputes, war, terrorism, utility failures, or failure of suppliers or transport networks.


20. Complaints & Dispute Resolution

If you have a complaint, please contact us at [Insert support email]. We aim to resolve issues promptly and fairly. If we cannot resolve a dispute, you may have rights to use alternative dispute resolution (ADR) mechanisms or to bring a claim in the courts of your jurisdiction as set out in Section 22.


21. Changes to the Services and These Terms

We may update Products, Courses, and these Terms from time to time. Changes will not affect Orders already accepted. The version posted on the Site at the time of your purchase or booking will apply to that transaction.


22. Governing Law, Jurisdiction & Mandatory Consumer Rights

  • These Terms and any non‑contractual obligations are governed by the laws of England and Wales.
  • If you are a Consumer resident in the UK or EU, you also benefit from any mandatory protections of your local law and may bring proceedings in your local courts.
  • Business Customers agree to the exclusive jurisdiction of the courts of England and Wales.

23. Privacy & Cookies

Your personal data is processed in accordance with our Privacy Policy and Cookie Policy, which form part of these Terms. Please review them carefully.


24. General

  • Severance: if any provision is found invalid or unenforceable, the remainder remains in force.
  • No waiver: failure to enforce a right does not waive it.
  • Assignment: you may not assign your rights without our consent; we may assign our rights and obligations on reasonable notice.
